Hi guys, I bought a motorcycle recenty and lost the VIC. The book is not under my name. I bought it from the 2nd owner which didnt transfer for his name either. I heard that without the VIC I cannot transfer. and I need a police report from the original owner. When I spoke to the 2nd owner who I bought from he said its not neccesory any more. I'm abit confused my friends say I need it.

I am unable to contact the old owner, is there any way around this? please help.

I think you have quite a problem. Firstly it is illegal to not transfer the ownership when you buy it, there is nothing to stop the previous owner from reporting the bike stolen, the VIC stolen and getting it off you, except maybe decency. VICs are not used, that's true, but if it as active VIC, (as in it hasn't been withdrawn by the RMV) you will need it for the transfer. Surely you know this??!! If I were you I would contact the RMV and anonymously request advice quickly!

Does the second owner have any documentation as evidence of sale and do you have any evidence that you have purchased this vehicle from the second owner like an invoice ? Normally you do when vehicles are kept on open papers.

Those documents are still evidence that the sale took place. What you probably will be able to provide a sworn affidavit with the evidence above that you are the legal owner of the vehicle and get it transferred to your name. Best consult the RMV and a lawyer who is experienced on vehicle transfer issues. If you don't have anybody let us know.

Guys I have a question in same line. I got my bike about 3 years back but hardly used it. I never remember I received the registration certificate (book) via post. But I do have VIC with me under my name. Can I get original book under my name?

I think you can get a duplicate book if you have lost the original.

The letter you have isnt enough. You will also need another letter saying the 1st owner sold it to the 2nd. who's to say the 2nd owner didnt steal it from the 1st owner.

And the 2nd owner, though he said he'll get police report, cant do so since the bike isnt under his name either. You're better off asking the 2nd owner for contact details of the 1st owner and going to him.

The problem here is the second owner might not want to give out such a letter since he is guilty of not properly transferring the vehicle to his name.

Speak to the RMV, tell them that you have just purchased a vehicle kept on open papers, you've got the book but have lost the VIC and ask for their advise. But as you know the RMV is full of kakkas so they might want money even for advice so try to speak to somebody sufficiently senior or a person who deals with the RMV on a regular basis (like somebody who works for a finance company).

The VIC system is obsolete they dont use it anymore

I think you are right. The new red/pink book comes without a VIC, but you probably need the VIC if you have the green book and want to transfer.

Maybe, just maybe if you can get hold of a inside person at RMV and give him some jarawa you wont probably need the VIC or other required documents for open papers. :D

yup the red pink book comes without Vic .

best thing to do is catch some fellow at the RMV and get the bike transfered its still on open papers ,so you can give a few extra cash and get it transfered,i hope you have the vic sticker .The legal way is that the original owner as mentioned in the book,file a case regarding the lost VIC and you can produce that to the RMV and get your transfer done . :rolleyes:

I dont mind paying to some guy at RMV, just need to get this done so I can sell the bike and move on. Any of you guys have any contacts at RMV? I am willing to pay. :S I barely know my way through the RMV. Can some one help me out, it will be really appriciated.

Guys , I'm also having an issue like dat. I have the Certificate of Registration, Photocopy of VIC and the copy of the police entry about the lost VIC. The Certificate is under previous owners name and I have properly singed (by the previous owner) transfer papers. will it be an issue to transfer? and will it be an effect to the vehicle selling price if I want to resell it?
