...and fine the owner of the car for allowing a minor to drive. I remember when I was in school a friend borrowed his brother's mo'bike to drop me home. We got copped and the poor elder brother had to go to courts. At the time it was a Rs. 500 fine which was a lot in 1991. We were just 16.

02 cases will be filed in the relevant Magistrates' Court against the minor and the owner of the vehicle.

The minor will be charged for driving without a licence and the owner will be charged for allowing his/her vehicle to be driven without a licence.

There is no provision to impound the vehicle. [However confiscation of the vehicle takes place for other offences -which is not under the MTA]

Mirage, if the driver is found to be under age, the police can't let the under age driver drive away the vehicle. So if I'm not mistaken they will impound the vehicle, contact the owner, charge the owner and the under age driver, and possibly release the vehicle to the owner.

You have more or less got it spot on MD. Same scenario with DD. Yes - from the place of detection - the cops have to drive the vehicle to their station and the owner can claim it. There isn't any impounding charge etc [as in some countries]-- however the ownership has to be verified, before releasing the vehicle. There needn't be a delay to release the vehicle (unless the cops needs you-know-what -to release the vehicle).

Also since you have to go to Court to face both charges, and as a delay is inevitable - the vehicle will be released by the police -- without waiting for the Court case to be over.

I thought I will add a post under on this thread.As the members are posting out of Automobiles.

This is not Automobile related matter as for Motorists we face lot of unwanted Questions from Police and other forces officers on the check points and Road blocks. At present there are few check points and Road blocks after the LTTE matter is over.The first question they ask is from where are you coming and where are you going they look at the people inside the vehicle and ask who are they instead of checking Identity cards. I think only questions can be asked in court of law.

As far as I know in this country we Srilankans can go any where without a permit other than any security protected place. no one can question that.

Do government security staff can question general public on high way movements within this country?

One more thing out of Colombo when ever we are stopped by police we have to get down from the vehicle and go their foot steps and answer questions have to go back to the vehicle and show the relevant documents what they request us to inspect. This practice is not there in other countries in the world.

I like to have members comments on this above matter.

This is true. The first (and only) time I was pulled over by a cop in USA for (light) speeding, he announced over a megaphone for me not to get out of the car: "stay in your vehicle, and keep your hands on the steering wheel"

He later told me that getting out of the car was a sign of coming at them with guns drawn/confrontation. Guess SL cops are too damn lazy to walk over to the car.

Yes the Govt Security staff has every right to question youo under the prevailing 'Emergency Law' that's periodically reviewed and passed in Parliament .

From my run-in's with the cops I've never really been asked to get out of the vehicle. I just stay put and wait for them to come over- if they don't I drive away :) The times I have got down are when I have been in the wrong and volunteered to get out to 'negotiate' :)

recently while having something to eat on da road side at a hotel at around 5am... a set of cop bikes came & stopped there too...they asked da waiter for food & while waiting for da food...there was a young couple walking with travelling bag...it was obvious that they were going to their village becoz it was just before avrudu & they were having travelling bags...the traffic cops stopped them & started questioning them...a pc who was their took their bags & checked them too....i really didnt see any reason for them to check the couple...it was pretty obvious that they were not terrorists & that they were going to their homes for the sinhala new year... :angry: well finally they let the couple go after about 10 minutes of questioning, The cops had their free Koththu & went off :alc:

Dont know about other people but i never go through any of this stuff :) They come up to the window, check the license and registration and then let me go.They dont ask me anything :P Also since the war ended i have rarely got stopped inside colombo, only a few times in the night i guess.

well i think sometimes those guys are just bored :P

the more you get good at playing their game...the easier it is to get out faster with least trouble.

I've tried fighting them head on on a few occasions previously but now can't be bothered. It's easier to just go with the flow imho :)

Or because no one gets out of their car in SL with a weapon. :D

I guess they think it's beneath them to walk over, a pride/not wanting to bow down, kinda thing.
